COVID-19 ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY

As consideration for Soulshine Arts Music Together® permitting me to take Music Together classes, I agree to the following:

ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at Soulshine Arts Music Together®, and present an inherent risk that cannot be eliminated. I acknowledge that, although Soulshine Arts Music Together® is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including Music Together Teachers, and third-parties), it is ultimately my responsibility to ensure that I and my child take appropriate actions to safe-guard ourselves, including all adults wearing masks during class. All family members must stay within their personal blanket/area and ensure that personal instruments/props are not shared between families. I understand and agree that as a registered member of Soulshine Arts Music Together®, I am accepting and voluntarily assuming the risk that I or my child may be exposed and become ill as a result of COVID-19 and other diseases.

WAIVER OF LIABILITY: I, on behalf of myself and my children hereby voluntarily release, forever discharge, and covenant not to sue Soulshine Arts LLC and its owners, managers, contractors, members, employees, agents, and volunteers, or homeowners David Pratt and Leslie Pratt (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus or COVID-19. I assume the inherent risk of being outdoors with my children including but not limited to ticks, bees, poison ivy, etc. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties.

I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES AT SOULSHINE ARTS MUSIC TOGETHER®, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.

 

 

Summer 2020:

For outdoor classes: In case of rain or excessive heat, classes will be held on Zoom. Families who miss individual classes can make them up using our online Zoom class scheduler. Absolutely no credits or refunds. 

 

Please keep an eye on the weather. If we are moving a class to Zoom due to inclement weather, you will be notified by our weather alert text messaging system. Please make sure to register for texting.  (https://soulshineartsct.com/smsoptin.aspx

  

We reserve the right to modify or change our offerings and terms of service at any time without notice. We shall not be liable to you or any 3rd party for modifications, price change, suspension or discontinuation of service. We cannot offer credits or refunds.

 

By registering for a class provided by Soulshine Arts I agree the following conditions;

Liability: I release, indemnify and agree to hold harmless Soulshine Arts, Leslie Pratt, Music Together LLC, Michelle Weinis, Green Woman & Your Childbirth LLC, and their respective directors, officers, employees, sponsors, teachers, and staff from any claim, suit, demand, or action arising in connection with mine or my child’s participation in programs operated at Soulshine Arts.

Installment Plans Automated Payment Processing: Installment plans are processed automatically. If your card has expired you'll recieve an email with instructions on how to update your payment method.

Photo/Video Release: By signing up for a class at Soulshine Arts I understand and accept that on occaision a photo or a video may be taken of mysef or my family to be used by Soulshine Arts for the purpose of marketing the program. If this is not acceptable for your family please contact director Leslie Pratt via email at lesliempratt@live.com.

Class Availability: All classes are subject to minimum and maximum enrollment requirements. Classes may be combined or split into two and class times may be altered to suit enrollment.  

Weather/Class Cancellation: In the event of winter weather or teacher absence you will be emailed the morning of class at the latest and there will be an announcement on Facebook www.facebook.com/soulshineartsct Please respond to the email to let us know you are aware of the cancellation.

Refunds/Credits: Refunds are provided only if the class you have paid for is cancelled and you cannot attend an alternate class. In all other cases you will be credited toward a future semester at the discretion of the Director if there has been a medical or family emergency which has prevented your attendance in class. There are no refunds/credits for natural disasters, community crisis, or circumstances beyond our control. 

Illness: Any children and any adults who may have a contagious illness, runny nose, cough, sneezing, fever, etc, may not attend class. We offer unlimited makeups for Music Together classes in order to provide as much flexibility for your family as possible. Thank you for keeping our community healthy. We have many tiny babies and pregnant mommies at Soulshine Arts and we work hard to protect everyone. Safety is our number one priority!

Make Ups/Absences: Makeup opportunities are based on availability. You MUST schedule in advance using the Makeup Scheduler and we ask you to mark any absences planned or unplanned in the portal to open your spot to other families. You may rollover unused makeups toward the following semester *only if* you are registered for the following semester. 

Teachers: Teacher assignments are subject to change and do not warrant a class change or cancellation. 

Food/Drink: Food and drink are not allowed in the classroom. Please be sure to clean up after your child.
